Old Bridge, NJ Public Conduct: Public Urination (2026)

Article II of Chapter 342, Peace and Good Order, was adopted in 1994 to address public urination and defecation alongside disorderly conduct. Section 342-2(A) is written broadly: it bars urinating or defecating on land belonging to anyone else, on a public building, street, park or other property owned by the Township or any other public agency, and separately makes it unlawful to urinate or defecate 'so as to be observed by another person,' regardless of whose property it happens on. Section 342-2(B) exempts only the ordinary use of a bathroom, water closet, latrine or similar site built for that purpose, so there is no exception for being outdoors, at an event, or unable to find a restroom in time.

The same article also bars disorderly conduct nearby: § 342-3 prohibits fighting or threatening behavior, creating a hazardous condition with no legitimate purpose, and directing unreasonably loud or offensively coarse language at another person in a public place. Section 342-4 sends every violation of the article, including public urination, to the Municipal Judge for sentencing 'subject to the discretion' of the court, applying the Township's general penalty found in Chapter 1, Article II: a fine of up to $1,250, up to 90 days of imprisonment or community service, or a combination. Because the article has no separate fine schedule of its own, the judge sets the actual penalty case by case within that ceiling.
