Tustin, CA Public Conduct: Public Urination (2026)

Tustin City Code § 6330 sits in Part 3, Urination and Human Waste, of the disorderly conduct chapter and states the rule in a single sentence: no person shall urinate or defecate on private property in an area exposed to public view, or on any public street, sidewalk, alley, park or other public place, except in a public restroom. The section dates to Ord. No. 9 and was last amended by Ord. No. 1067 in 1991. Because the prohibition covers private property exposed to public view as well as public rights-of-way, it reaches conduct in parking lots, front yards visible from the street, and building exteriors, not only City streets and parks.

A companion provision, § 6350, was adopted in 2012 to address a related problem: transients occupying commercial properties overnight and leaving urine and waste behind, and it allows business owners to post signage barring after-hours presence so trespass laws can be used against that conduct. No penalty is written into § 6330 itself, so a violation is governed by the Code's general penalty section, § 1121, which sets escalating infraction fines before a repeat offense becomes a misdemeanor. Enforcement officers with arrest authority for Code violations are designated in § 1132, and sworn police officers may issue citations under § 1121 and § 1133's citation procedures.
