No person, while in possession of a skateboard or like device, shall go upon the parking lot area or other private property of any retail, commercial and/or industrial business establishment at any time when such premises are not open to the public for business, except with the consent of the owner.

04(a) prohibits anyone on roller skates, a skateboard, or riding a coaster or similar toy vehicle from going onto a roadway, except while crossing at a crosswalk or on streets specifically authorized as play streets. Subsection (b) separately bars anyone on a skateboard from entering the parking lot or adjacent premises of any retail, commercial or industrial business without the owner's consent, and bars carrying a skateboard onto that property at all when it's closed to the public, again absent consent. or after half an hour before sunset; only one such ramp is allowed per single- or two-family lot.
Subsection (d) authorizes any police officer to seize a device used in violation of the section, and the Chief of Police impounds it at the station for 30 days under subsection (e), with written notice going to the owner or, if a minor, to the parent or guardian. 08(d).
Violations & Fines
Violating the roadway ban in division (a) or the ramp-construction standards in division (c) is a minor misdemeanor for a first offense under Section 311.04(h), escalating to a misdemeanor of the fourth degree for a second or subsequent offense, punished under Section 303.99(a). A seized skateboard or similar device is held by the Chief of Police for 30 days and released only on proof of ownership, without excusing any penalty already imposed.
