Full Breakdown
Chapter 9.16 of the Yucaipa Municipal Code regulates skateboards, roller skates, in-line skates and similar devices on posted property and within the Market Night area. In § 9.16.010 the Yucaipa City Council finds that unregulated skating on public sidewalks, in public parking lots and in other locations frequented by the public creates a hazardous condition, and that in heavily accessible areas the problem is addressed by regulation and by prohibition through appropriate signage.
Section 9.16.020 sets out three bans. Subsection A applies to public or private property where notice of the prohibition has been posted and is clearly visible, at minimum, within two entrances to the prohibited area or in the immediate area. Subsection B bans the activity inside any municipal parking facility, with no posting condition. Subsection C applies to any public sidewalk where notice is posted in the designated areas of prohibition. Each ban reaches skateboards, roller skates, in-line skates and any similar self-powered wheeled device having wheels less than six inches in diameter. Subsection D exempts persons participating in any city sponsored program, event or class in which those devices are utilized, permitted or required.
Section 9.16.025 adds a wider rule for Market Night, the city approved event in the Uptown Historic district that includes a Certified Farmer's Market, merchandise vendors, produce vendors and food vendors, occurring on a weekly basis or at other times as approved by the city council. On any public street, public sidewalk or public property located adjacent to the Market Night perimeter, it is unlawful and a public nuisance to ride a bicycle, unicycle or similar self-powered wheeled device, or to ride a skateboard or use roller skates, in-line skates or any similar device with wheels less than six inches in diameter. The same exemption for city sponsored programs, events and classes applies.
Violations & Fines
Section 9.16.030 makes a violation an infraction. On conviction the fine is not less than $25 and not more than $100 for a first violation, not less than $50 and not more than $200 for a second violation, and not less than $150 and not more than $500 for a third violation within one year. A fourth and any additional violation within one year is a misdemeanor, punishable by a fine of not less than $300 nor more than $1,000, six months in jail, or both.
