Westfield, IN Public Health Rules: Rodent Control (2026)

Sec. 34-40 of the Westfield City Code lists "infestation" among the conditions it makes unlawful for "any owner, occupant, manager or person having control of any property" to permit or cause: item (3) bars "the causing or permitting of any significant rodent or insect population to exist on any property, or to cause or permit any condition which would attract such population," cross-referencing IC 16-1-27-4. The same section separately treats significant airborne odor, dust or smoke, and significant noise, as public nuisances when they render ordinary use and enjoyment of nearby property uncomfortable or impossible, and a catch-all item sweeps in any other condition recognized as a nuisance at common law or under state statute.

Sec. 34-41 turns the nuisance list into an ongoing maintenance duty, requiring the owner or person in control of private property to "maintain the premises free of litter and nuisances" at all times, though it does not bar storing litter in authorized private receptacles. Violations of the nuisance provisions, including a rodent or insect infestation left unaddressed, are class C infractions under IC 34-4-32-4 per Sec. 34-43, exposing the responsible party to a judgment of up to $500.00, with a new offense deemed committed for each day the infestation or nuisance continues.
