Westfield, IN Noise Ordinances: Amplified Music & Outdoor Sound (2026)

Sec. 34-51 of the Westfield City Code bars anyone from playing, using or operating "any machine or device for the producing or reproducing or sound, including, but not limited to, loudspeakers, radios, CD players... musical instruments, phonographs, cassette players or any other machine designed or intended to produce or reproduce sound" when the resulting noise crosses one of two thresholds. On public property, including a right-of-way, street, building, sidewalk, park or thoroughfare, the sound violates the section if it is "clearly audible 40 feet or more from its source, or is at a level of 90 decibels or more when measured from a distance of not less than six feet from its source." On private property, the same 40-foot audibility or 90-decibel test applies at the property line rather than at the source.

The city carves out specific exemptions elsewhere in this noise division, including for emergency vehicles, alarms, city-authorized events, and properly muffled lawn and construction equipment during set daytime hours. Sec. 34-53 grades the fine by how many violations occur within a rolling two-year window: up to $250.00 for a first offense, $500.00 for a second, $1,000.00 for a third, and up to $2,500.00 for a fourth or later offense. Sec. 34-54 lets the city seek injunctive relief and recover attorney fees in addition to the fine, and treats each day of continuing violation as a separate offense.
