Westfield, IN Noise Ordinances: Construction Hours (2026)

Sec. 34-52 of the Westfield City Code lists the sources exempted from the general sound-equipment ban in Sec. 34-51, and item (2) limits the construction-equipment exemption to a specific window: "Lawn mowers, garden tractors, construction equipment, and power tools, when properly muffled, between the hours of 7:00 a.m. and 10:00 p.m. only." Outside that window, running construction equipment, a lawn mower or a power tool loses its exemption and falls back under the general Sec. 34-51 sound-equipment standard rather than being automatically lawful. Even inside the 7:00 a.m. to 10:00 p.m. window, the exemption only protects equipment that is "properly muffled"; an unmuffled compressor or generator running at noon is not automatically exempt under this item.

The same Sec. 34-52 list also carves out emergency-vehicle sounds, properly installed and promptly silenced burglar alarms, city-authorized parades and concerts, sporting events, legal fireworks, an approved public-safety training facility, and the ordinary incidental sound of an established business. Sec. 34-53 fines any resulting violation up to $250.00 for a first offense within two years, rising to $500.00 for a second, $1,000.00 for a third, and up to $2,500.00 for a fourth or later offense, and Sec. 34-54 treats each day of a continuing violation as a separate offense while allowing the city to pursue injunctive relief and attorney fees.
