Hoboken, NJ Rental Inspections: Inspection Programs (2026)

Section 120-2 accepts the New Jersey State Rules for Maintenance of Hotels and Multiple Dwellings, N.J.A.C. 5:10 et seq., as the standard the City uses to judge whether Hoboken dwellings are safe and fit for human habitation and rental, with copies on file at the City Clerk's office. Section 120-1 designates the Director of the Department of Environmental Services as the administrative officer who exercises the chapter's powers without extra salary, and Section 120-8 authorizes specific employees within the Division of Housing Inspection, titled Chief Field Representative, Property Improvements, Housing Inspector, and Senior Housing Inspector among others, to actually carry out inspections and enforce the code.

Section 120-3 gives the Director authority to enter, examine and survey every dwelling, dwelling unit, rooming unit and premises in Hoboken at all reasonable times to safeguard occupant and public safety, and requires owners and occupants to grant free access for that purpose. When an inspector finds reasonable grounds for a violation, Section 120-4 requires written notice stating the reasons and a deadline to comply; the recipient can petition for a hearing before the Director within ten days, and the Director must convene it within ten more days and issue a written decision that becomes an order if unappealed.

Emergency conditions let the Director issue an immediate compliance order without a prior hearing, with a hearing offered afterward. Section 120-6 bars renting or occupying any dwelling that fails to meet the adopted maintenance standards, and any person aggrieved by a Director's decision may seek relief in a court of competent jurisdiction.
