Roseville requires the owner of any rental property with one to four units to register it with the city before anyone occupies it. Registration lasts one year (365 days), owners outside seven named metro counties must name a local agent, and a lapse of 60 days bars renters from the property.
Except as provided in sections 1201.18 (a) and 1201.20 , it shall be unlawful for any person to hereafter occupy, allow to be occupied, or let to another person for occupancy any residential rental property of one to four units within the city for which an application for registration has not been properly made and filed with the city or after the time that a registration is suspended or revoked. Registration shall be made upon forms furnished by the city for such purpose and shall specifically require the following minimum information: (1) Name, street address and phone number of the property owner and, if the owner is a business entity, the name, street address and phone number of a designated agent for the owner. ... (3) The street address of the rental property. (4) The type of units within the rental property (single-family, twinhome, townhome, condo, duplex, triplex or fourplex). Full Breakdown
Roseville's registration program covers residential rental property of one to four units, which includes single-family homes, twinhomes, townhomes, condos, duplexes, triplexes and fourplexes. Section 1201.13 states the purpose: gather accurate owner contact information, provide educational materials to owners and occupants, identify and quantify these units, and give the city a way to enforce minimum safety, health, fire, property maintenance and zoning standards. Buildings with five or more units are outside this division and are licensed as multifamily rental dwellings under division 3. Short-term rentals are licensed under division 4.
The registration form must list the owner's name, street address and phone number. A business-entity owner must name a designated agent. If the owner lives outside Anoka, Carver, Dakota, Hennepin, Ramsey, Scott or Washington counties, the owner must also name a local agent who is authorized to make or order repairs and who lives or works in one of those counties. The form also asks for the property address, the unit type, the number of bedrooms and bathrooms, and an attestation that maximum occupancy is either four or fewer unrelated adults or one family under section 906.18.
Under section 1201.16, each registration takes effect on issuance and expires one year (365 days) later. Renewal materials must arrive before the expiration date. A renewal submitted 30 days after expiration is late and carries fee penalties. A registration not renewed within 60 days of expiration is in violation, and renters cannot occupy the property until the renewal is received. Section 1201.18 sets the other deadlines: register before converting a property to a rental, file a new form within 30 days of a change in occupancy type, and a new owner must register within 30 days of a sale if the property stays a rental. Section 1201.19 requires a current copy of the registration certificate to be posted in each rental unit, including the registration expiration date and information on the state attorney general's landlord and tenant handbook.
Section 1201.20 exempts some owners from the registration fee and the posting requirement, such as owners renting only to listed close relatives and owners of state-licensed group homes. Owner-occupied rentals and non-detached accessory dwelling units are also listed as exemptions. An owner must notify the city in writing within 30 days if an exemption stops applying. All fees and fines are charged to the property owner under section 1201.17.
Violations & Fines
Under section 1201.22, maintaining a rental property without registration, or after registration is suspended or revoked, or permitting new occupancy in violation of the chapter, is a misdemeanor, and each day of each violation is a separate offense. The city can also impose administrative fines set in the city fee schedule, in addition to or instead of a misdemeanor charge. Until the fine is paid and a registration is obtained, the unit cannot be occupied by anyone but the primary homestead owner and immediate family. Under section 1201.21 the City Council can suspend a registration for at least 180 days on a first suspension and 365 days on a second, and can consider revocation after two prior suspensions.
