Casa Grande, AZ Right to Farm: Farm Nuisance Protection (2026)

Chapter 9.24, Prohibitions Against Unreasonable or Excessive Noise, makes it unlawful under Section 9.24.010 to make disturbing, excessive or offensive noise causing discomfort to a reasonable person, judged by factors including the noise level, whether it is usual or natural, ambient noise, proximity to sleeping areas, zoning of the area, time of day, duration, and whether it is recurrent. Construction is separately time-restricted under Section 9.24.040, generally running 5:00 a.m. to 9:00 p.m. in residential-adjacent zones from April 15 to October 15 and narrower hours the rest of the year, with a city manager permit needed for different hours.

Against that backdrop, Section 9.24.050 lists activities the council exempted outright, and item 3 removes "operation of agricultural equipment in connection with farming operations" from the chapter entirely: no time-of-day cutoff, no discomfort test, no civil sanction applies to that equipment noise. The exemption is narrow, though. It protects only agricultural equipment tied to farming operations, not general farm noise, livestock sounds, dust, odor or other nuisance complaints, which fall back under the ordinary noise or nuisance provisions unless they independently qualify as exempt. Casa Grande's code has no standalone right-to-farm statute barring nuisance claims against agriculture broadly; the protection here is confined strictly to this noise-chapter carve-out for equipment used on the farmland around the city.
