Weston, FL Short-Term Rentals: Host Presence Rule (2026)

§ 81.05, Owner and Vacation Rental Agent Requirements, lists eight affirmative duties that fall jointly on the owner and the designated Vacation Rental Agent. Subsection (C)(6) is the host-presence rule: the Agent must be available with authority to address and coordinate solutions to problems with the rental at all times, 24 hours a day, seven days a week, and must be physically present at the property to respond to emergency calls within one hour of notification. That duty sits alongside § 81.03, which already requires the Agent to reside within 30 miles of the rental so a one-hour response is realistic, and § 81.02(F), which requires the application to list the Agent's name, address, and 24-hour phone number, with that number 'answered at all times.' The same subsection (C) also makes the Agent responsible for keeping a register of transient occupants open to City inspection (C)(7) and for screening against the Florida Sexual Offenders and Predators database under the City's Sexual Violator Residency Prohibition, § 52.45 (C)(8).

Failing the one-hour presence duty is treated as a violation of Chapter 81's owner/agent requirements, which the Special Magistrate can punish under § 81.08(E), including Certificate of Use suspension for repeat violations within a 48-month window.
