Full Breakdown
Chapter 313 of the Roseville City Code regulates guest conduct by pointing at the city's general rules. Section 313.07(b) requires the owner or its agent to post in each short-term rental unit a current copy of chapters 404, 405, and 602, or an alternative form approved by the city. Those chapters cover noise control, nuisances, and stopping, standing and parking. Section 313.07(a) separately requires the current license, with the owner or local agent's name, address, email and phone numbers, to be posted in the unit.
Chapter 404 supplies the actual noise standards. Section 404.01 bars any person from making or causing any distinctly and loudly audible noise that unreasonably annoys, disturbs, injures or endangers the comfort, repose, health, peace, safety or welfare of any person. Section 404.02(e) treats sound from a radio, musical instrument or other sound device that is plainly audible at the property line, in an adjacent hallway or apartment, or at 50 feet when the source is in a structure, between 10:00 p.m. and 7:00 a.m. as prima facie evidence of a violation. Section 404.02(f) addresses parties: no person can participate in a gathering that gives rise to noise disturbing the peace, quiet or repose of another, and a police officer who finds a noise disturbance can order everyone except the owner or tenant to disperse. Owners and tenants who know of the disturbance must make every reasonable effort to stop it.
The license consequence is in Section 313.09(a)(4): violations committed or permitted by the tenant or the tenant's guests of the rules governing the premises, including chapters 404, 405, 508, 906, 1004, 1005, and 1013, are grounds for the city council to suspend or revoke the license. Repeat nuisance service call fees apply under chapter 508.
Violations & Fines
A noise or nuisance violation by guests counts against the owner's license. Two or more confirmed violations within 180 days are grounds for council suspension or revocation under Section 313.09(a)(1), a single violation that posed a public safety threat can bring an administrative suspension by the city manager on the police chief's recommendation, and suspensions run at least 180 days for the first and 365 days for the second.
