Under the Las Cruces short-term rental ordinance, occupancy is limited to two people per bed plus two additional people per unit, with children under age two excluded from the count. Gatherings are separately capped: a rental cannot host more than 15 people above the allowed number of renters, or more than twice the renter limit, whichever is greater. These limits, along with a local responsible contact and neighbor notification within 500 feet, are meant to keep rentals compatible with residential neighborhoods. Rules took effect January 1, 2026.
Exceeding occupancy or gathering limits is a nuisance offense: $50-$300 first, $300-$500 later, with mandatory registration revocation after five offenses within three years.
