The ordinance was unanimously adopted by Smyrna City Council in 2022 after a multi-year drafting process and reviews of STR rules in Sandy Springs, Brookhaven, Hall County, South Fulton, Macon, Savannah, Columbus, and Atlanta. The occupancy formula is straightforward: two persons per bedroom plus three additional persons (for example, a 3-bedroom STR can host up to 9 guests). A 'short-term rental' is defined as a rental of 30 days or less. Single-family non-owner-occupied STRs are additionally capped at 180 days of rental activity per calendar year; owner-occupied STRs have no day cap. Stays exceeding 30 consecutive days do not count toward either definition or the 180-day cap. Owner-occupied STRs (where the host claims the home as a primary residence with a homestead exemption or affidavit-in-lieu) are exempt from the 180-day cap. The maximum-occupancy figure must be disclosed on the application and is enforced by Smyrna Code Enforcement and the Community Development Department. Hosts using Airbnb or Vrbo should set their listing's maximum guest count to match the formula to avoid violations.
Operating an STR over the posted occupancy or beyond 180 days where the cap applies is a code violation enforced by Community Development. Penalties under Smyrna Code can include fines and revocation of the Short-Term Rental License if convicted in Municipal Court.
