Full Breakdown

Toms River Township Code Article VI generally bans renting a dwelling, or any part of it, for terms under 30 days. Section 335-41 carves out a narrow exception for renting a single room to one tenant, but only if every listed condition is met: including that 'there is sufficient space on the subject property to lawfully provide one on-premises parking space for the tenant's vehicle.' The room rental must also run at least one month, and the dwelling must remain owner-occupied year-round.

Violations & Fines

Room rentals lacking on-site tenant parking, or violating any other § 335-41 condition, are treated as unauthorized short-term rentals; owners face maximum municipal fines under N.J.S.A. 40:49-5 and 40:69A-29, plus certificate revocation.
