Summary

Leaving anything, temporary or permanent, in a Flagstaff street, alley, sidewalk, or multiuse path without a permit is against the law. City Code § 8-13-001-001 lets the City seize and impound the obstructing item, charging a $100 fee to get it back, and treating anything unclaimed after 90 days as abandoned.

A. It shall be unlawful for any person or entity to obstruct or encumber, in part or entirely, any portion of any public street, alley, sidewalk, multiuse path, or any other public right-of-way within the corporate limits of the City with any item, whether temporary or permanent, except as allowed with an applicable permit under this code or pursuant to an express authorization in another section of this code that authorizes certain, specific temporary use or obstruction. B. If property is found in violation of this section it may be seized and impounded after reasonable efforts are made to locate the owner. An impoundment fee of one hundred dollars ($100.00) shall be assessed and paid for the redemption and release of the property. If property is not claimed within ninety (90) days of impoundment it will be considered abandoned and subject to destruction or sale.

Full Breakdown

Section 8-13-001-001, enacted by Ordinance 2019-19 on June 18, 2019, makes it unlawful for any person or entity to obstruct or encumber, in part or entirely, any portion of any public street, alley, sidewalk, multiuse path, or any other public right-of-way within the corporate limits of the City with any item, whether temporary or permanent. The prohibition is broad by design, covering everything from a parked trailer to a sandwich board sign to construction debris left on a sidewalk, and it applies unless the item is allowed under a permit issued elsewhere in the Code or an express authorization for a specific, limited use, such as the sidewalk cafe and vending cart permits in Division 8-03-002 or the temporary right-of-way closure permits for parades and street fairs in Section 8-03-001-0005.

This section works alongside more specific right-of-way rules elsewhere in Title 8: Section 8-03-001-0004 separately requires property owners to clear snow and ice from abutting sidewalks within 24 hours, and Section 8-01-001-0001 puts general sidewalk repair on the adjacent owner. Where those specific sections don't cover a given obstruction, Section 8-13-001-001 is the catch-all: the City doesn't just issue a citation, it can physically seize and impound whatever is blocking the right-of-way after making reasonable efforts to find the owner, turning an obstruction complaint into a straightforward property-recovery matter rather than a drawn-out abatement case.

Violations & Fines

An obstructing item can be seized and impounded once the City makes reasonable efforts to find the owner. Getting it back costs a $100 impoundment fee under Section 8-13-001-001(B). If nobody claims the item within 90 days of impoundment, the City treats it as abandoned property and can destroy or sell it, on top of whatever citation the person who left it there may also face.

Frequently Asked Questions

Can I leave a sign or trailer on a Flagstaff sidewalk?
No, not without a permit. City Code § 8-13-001-001(A) bans obstructing or encumbering any public street, alley, sidewalk, or multiuse path with any item, temporary or permanent, unless it's authorized by a permit or another specific Code section, like the sidewalk cafe or vending cart rules. Unauthorized items can be seized.
What does it cost to get an impounded item back from the City of Flagstaff?
Section 8-13-001-001(B) sets a $100 impoundment fee to redeem and release property seized for obstructing a public right-of-way. The City tries to locate the owner first, and if nobody claims the item within 90 days of impoundment, it's treated as abandoned and can be destroyed or sold.
Are sidewalk cafes and vending carts exempt from Flagstaff's obstruction ban?
Yes, when permitted. Section 8-13-001-001(A) exempts items allowed under an applicable permit, and Division 8-03-002 of the City Code sets up the specific permitting process for sidewalk cafes, sidewalk vending carts, and similar encroachments, so a permitted cart doesn't violate the general obstruction prohibition.
