Hoboken regulates solar installations under § 196-35.1, covering roof-mounted arrays, nonhabitable-structure installs like carports and trellises, and ground-mounted, freestanding systems, each with its own design standards for wind load, roof setbacks, height and lot coverage. Whatever the installation type, § 196-35.1F requires a first certificate of zoning compliance, issued by the Zoning Officer, and a building permit before construction starts; site plans that fall outside the section's listed parameters get a compliance denial and go to the Planning Board for individual review instead. The Construction Official will not issue the building permit until the installer has met the safety and installation requirements for roof or nonhabitable installations and complied with the Uniform Construction Code at N.J.A.C.
