Section 17.84.270.E.3 allows outdoor dining to extend beyond the tenant's own parcel onto a contiguous adjacent parcel or onto the public right-of-way immediately next to the tenant space, but only as an accessory use and only with a City-issued encroachment permit; the section does not create a stand-alone right to occupy the street or sidewalk. Whatever the location, the seating must still meet the chapter's general outdoor-dining standards: an unobstructed four-foot pedestrian pathway, compliance with the City's adopted design standards, and hours of 8:00 a.m. to 10:00 p.m. unless a Zoning Administrator Permit authorizes later hours or proximity to housing. Section 17.84.270.E.5 specifically bars any structure or enclosure for trash or garbage storage on, adjacent to, or separate from the public sidewalk or right-of-way, and requires the dining area to remain free of litter at all times. A City-issued Special Event Permit is required if the right-of-way seating is tied to an organized outdoor event rather than day-to-day dining.
