East Orange, NJ Special Events & Permits: Sidewalk Dining & Cafés (2026)

City Code § 51-100C(1) lists outdoor dining as a permitted accessory use in the Central Avenue Central Business District (CBD), and the identical sentence repeats verbatim for the Main Street Entertainment (MSE) District at § 51-101C(1) and the C-1 Neighborhood Commercial pocket districts at § 51-102C(1): it must be accessory to a table-service restaurant, not a standalone use. The C-2 Gateway Commercial district's accessory-use list, by contrast, names only parking lots, so outdoor dining is not an accessory use there. Every commercial-district permitted use, including this accessory dining, must also meet the citywide performance standards in § 51-116: no noise above what other city ordinances allow, no noxious odor detectable outside the structure, no exterior storage exposed to view from adjoining premises or public rights-of-way, and no glare or nuisance detectable at the property line.

Section 51-116B puts the burden on the applicant to present satisfactory evidence of compliance to the Administrative Officer, who may require expert advice at the applicant's expense. There is no dedicated permit fee schedule for outdoor cafe seating printed in Chapter 51; a restaurant operator working within the CBD, MSE or C-1 boundaries applies through the ordinary zoning/site-plan process rather than a separate sidewalk-dining license.
