Highland, CA Special Events & Permits: Sidewalk Dining & Cafés (2026)

Highland Municipal Code § 16.44.210 states its intent plainly: to control the establishment and operation of sidewalk cafes, which can enhance the pedestrian ambiance of the city, while establishing regulation to ensure they do not adversely impact adjacent properties and surrounding neighborhoods. A cafe in the City of Highland must comply with this section in addition to the property development standards and permit procedures for the district in which it is located, so the district's own permit track still applies.

Five minimum development requirements apply. First, the cafe is an accessory use, so it cannot exist without a legally established restaurant or other eating and drinking establishment behind it. Second, awnings or umbrellas are allowed, but there can be no permanent roof or shelter over the cafe area, and awnings must be adequately secured, retractable, and compliant with the adopted fire and building codes and standards. Third, the furnishings consist only of movable tables, chairs, and umbrellas, although lighting fixtures can be permanently affixed onto the exterior front of the main building. Fourth, no structure or enclosure to accommodate the storage of trash or garbage can be erected or placed on or adjacent to the cafe on the public sidewalk or right-of-way, and the cafe must remain clear of litter at all times. Fifth, hours of operation are limited to the hours of operation of the associated restaurant or eating and drinking establishment.

Two neighboring rules matter for operators. Under § 16.48.080, no operation, activity, sign, or lighting fixture can create illumination that exceeds 0.5 foot candles minimum maintained on any adjacent property, and all lighting must be designed to project downward. Under § 16.04.040(A), the community development director, code compliance officer, building official, public works director and law enforcement officers all enforce the provisions of Title 16, which includes this section.
