Kyle, TX Special Events & Permits: Sidewalk Dining & Cafés (2026)

Section 53-673 sets the special standards that apply on top of the base use list for Kyle's Community Commercial (CC) zoning district, the district built for retail nodes along major collectors and thoroughfares. The section states plainly that permanent outdoor storage is not allowed, but that outdoor dining is allowed, without requiring a separate permit for the outdoor seating itself. Limited outdoor merchandise display is allowed too, capped at no more than 10 percent of the lot area, with merchandise barred from being left outside overnight, and no outdoor display permitted in any of the site's required off-street parking spaces.

First floors in the CC district are capped at 15,000 square feet, which shapes how large a restaurant's indoor footprint, and by extension its outdoor dining area, can be on a single site. Hours are the other major limit: a CC business within 300 feet of any residentially zoned or residentially used property cannot open before 6:00 a.m. or stay open past 10:00 p.m., though the code allows extended Friday and Saturday hours to midnight, by right for businesses 150 feet or more from single-family property, or by conditional use permit for businesses closer than that.

The identical outdoor dining allowance appears in Section 53-666 for the smaller Neighborhood Commercial (NC) district, with a lower 10,000-square-foot building cap, so a sidewalk cafe or patio is treated the same basic way in both of Kyle's neighborhood-serving commercial districts. Because these are Chapter 53 zoning standards, exceeding the display cap, storing merchandise or dining equipment outside overnight, or operating past the hour limits without a conditional use permit is a zoning violation subject to the city's enforcement process.
