Muncie, IN Special Events & Permits: Sidewalk Dining & Cafés (2026)

Muncie City Code § 96.44(A)(1) requires a right-of-way occupancy permit before placing 'furniture, tables, chairs, umbrellas, and/or other seating for outdoor dining/drinking/entertainment' in the ROW, along with mobile sandwich-board signage and fencing enclosures, all grouped as minor 'economic amenity' encumbrances. Under § 96.45(A), the building department reviews the application and issues the permit on the board's behalf once it confirms compliance with the board's occupancy standards; a restaurant using several pieces of dining furniture in one area needs only one permit, sized by the square footage occupied.

Section 96.46(B) requires minor-encumbrance permits, including sidewalk dining, to be renewed annually in the first quarter of the calendar year, and the board may add a separate occupancy-rate user fee tied to the square footage covered, billed at renewal. Section 96.44(A)(5) keeps a mobile food truck at least 30 feet from any permitted outdoor dining/drinking/entertainment amenity, unless the two are part of the same special event permitted under § 96.42. A short-term sidewalk sale of goods, by contrast, needs no occupancy permit if it runs seven consecutive days or fewer and no more than three times a year, provided ADA and public safety access is maintained. Encumbrances that involve attaching fixtures to a building in a local historic district also need a certificate of appropriateness.
