Yuba City, CA Special Events & Permits: Sidewalk Dining & Cafés (2026)

Adopted as the "Outdoor Dining Ordinance" by Ordinance No. 004-21, Article 49 lets restaurants, coffee shops, delis, bars, ice cream stores, bakeries and similar eating and drinking establishments expand seating outdoors "without requiring a special permit," per Sec. 8-5.4901. Sec. 8-5.4904 instead requires an over-the-counter application to the Development Services Director for an administrative permit, including a scaled site exhibit showing tables, chairs, barriers and access points, copied to the Police and Fire Departments. No conditional use permit is needed as long as the outdoor use does not obstruct vehicular circulation and is not barred by an existing entitlement; multiple outdoor dining areas are allowed but the total cannot exceed 1,000 square feet under the administrative process, and anything larger needs a conditional use permit.

Outdoor dining follows the restaurant's existing hours of operation, but use of the area itself is barred before 7:00 a.m. and after 10:00 p.m., except locations more than 400 feet from residential or other sensitive uses may stay open until 11:00 p.m. Thursday through Saturday. A four-foot clear travel path must be maintained past the seating at all times, and the area must comply with the Noise Ordinance at Title 4, Chapter 17.

Sidewalk seating specifically, in the City's own right-of-way, additionally requires an encroachment permit under Sec. 7-16.58 plus a zoning clearance, per Sec. 8-5.4905. The City charges no rent for the encroachment area but can revoke the permit at the Public Works Director's discretion if the space is needed for a municipal purpose or becomes a nuisance. Sec. 8-5.4906 makes clear the permit creates no vested property right, so the City can amend or repeal the ordinance without triggering a compensation claim.
