Florida Pool Barrier Requirements Apply Statewide

Chapter 515, Florida Statutes, requires that new residential pools, spas, and hot tubs constructed after October 1, 2000 meet at least one safety feature. Acceptable barriers must be at least 48 inches high, with gaps under 4 inches and self-closing/self-latching gates. Alternatives include approved safety pool covers, exit alarms on doors leading to the pool, or all doors equipped with self-closing devices. The Act applies in every Florida jurisdiction; local governments may adopt stricter standards but cannot waive them.

Failure to provide a required pool safety feature is a second-degree misdemeanor under F.S. 515.29, punishable by up to 60 days jail and a $500 fine, plus mandatory completion of a drowning prevention program.
