Montgomery requires swimming pools to be enclosed by a fence or barrier at least 4 feet high with a self-closing, self-latching gate. This follows the International Swimming Pool and Spa Code adopted by the city.
Montgomery adopts the International Swimming Pool and Spa Code through its building code (Chapter 5). All residential swimming pools must be enclosed by a barrier at least 48 inches (4 feet) high. Gates must be self-closing and self-latching, with latches placed at least 54 inches above grade on the exterior side. Openings in the barrier must not allow passage of a 4-inch sphere. The barrier requirement applies to both in-ground and above-ground pools. Pool covers and alarms may supplement but do not replace the fence requirement.
Failure to maintain proper pool barriers may result in citations, fines, and potential liability in the event of an accident.
