Pool barriers must be at least 48 inches (4 feet) tall measured from the outside. Openings in the barrier must not allow a 4-inch sphere to pass through. Horizontal members must either be at least 45 inches apart or located on the pool side of the barrier. Gates must be self-closing, self-latching, and open outward away from the pool. Latch release mechanisms must be at least 54 inches above the ground or on the pool side. Above-ground pools with walls 48 inches or higher may use the pool wall as the barrier, with a removable or lockable ladder. Homes with doors opening directly to the pool area must have alarms or automatic pool covers compliant with ASTM F1346.
Non-compliant barriers are strict-liability violations with fines up to 1,000 dollars. Pool may be ordered drained until compliance.
