Building a swimming pool or spa in Fresno requires a construction permit, and whenever that permit is issued for a new or remodeled pool the pool must be equipped with at least two of seven specified drowning-prevention safety features under Health & Safety Code 115922. Only small prefabricated above-ground pools accessory to a single-family home that are less than 24 inches deep and hold no more than 5,000 gallons are exempt from the building permit.
Pool construction in Fresno is permitted and inspected by the City's Development and Resource Management Department under the 2022 California Residential Code and the California Swimming Pool Safety Act. The person entering into an agreement to build a pool or spa must give the consumer the notice of these requirements (Health & Safety Code Section 115924).
Before the pool is plastered or filled, the barrier, gates, self-closing devices, exit alarms, and safety hardware must be in place, inspected, and approved; the local building official inspects the required drowning-prevention features prior to final approval. Constructing a pool without the required permit, or filling it before inspection approval, is a code violation subject to stop-work and after-the-fact permitting.
