California Senate Bill 793 bans the retail sale of most flavored tobacco products statewide, including menthol cigarettes and flavored vape pods. Moorpark retailers must comply or face state and local enforcement.
California voters ratified SB 793 in November 2022 through Proposition 31, ending retail sales of flavored tobacco products. The ban covers menthol cigarettes, flavored cigars, flavored chewing tobacco, and flavored electronic cigarette liquids. Loose-leaf premium cigars, shisha hookah tobacco sold in licensed lounges, and pipe tobacco are exempted. Online sales to California addresses are also banned. Moorpark retailers, including gas stations and convenience stores along Los Angeles Avenue and Princeton Avenue, must remove flavored products from shelves. Ventura County Environmental Health and the California Department of Tax and Fee Administration enforce through inspections and undercover compliance checks.
Selling flavored tobacco brings state fines of $250 to $1,000 per violation, possible suspension of the tobacco retail license, and additional penalties under local administrative citation authority.
