Municipal Code section 13-5 makes city refuse service mandatory: 'It shall be mandatory for every property owner within the city to receive city disposal service and billing therefor, except those industrial businesses whose volume of waste might exceed what services the city could offer.' The city council sets the minimum levels of residential, commercial and industrial refuse service by resolution, and the city manager or designee can require service above that minimum to protect public safety, health and welfare. Section 13-7(A) then fixes how that service is delivered: the city provides collection 'from all dwelling units in the city at frequencies and amounts to be determined by city council and set by resolution,' with residential service defaulting to curbside unless the city manager authorizes otherwise.

Sections 13-7(B) and (C) require curb-service customers to place containers at the curb or property line and alley-service customers to place them at the property line in through alleys, both on schedules the city manager sets, while section 13-7(D) allows bin container service for apartments, multiple dwellings, or single-unit dwellings the city manager approves. Charges for this mandatory service are billed with the regular city utility bill under section 13-14, and a ten percent penalty applies if a bill goes unpaid thirty days after the billing date, with utility service subject to discontinuation after forty-five days delinquent.
