Albany, OR Trash & Recycling: Dumpster Rules (2026)

The container limits for commercial and industrial customers in the City of Albany, Oregon, sit in Albany Municipal Code § 3.28.140, titled Public responsibility. Paragraph (3) is the operative dumpster rule: no stationary compactor or other container for commercial or industrial use shall exceed the safe loading design limit or operation limit of the collection vehicles provided by the franchisee serving the service area. The size and loading capacity of a business's container are therefore tied to what the trucks of Albany-Lebanon Sanitation can safely handle.

The same paragraph gives customers a route around that ceiling. Upon petition of a group of customers reasonably requiring special service, the City Council can, where economically feasible, require the franchise to provide subcontract provisions for vehicles capable of handling specialized loads. The petition goes to the Council. Subcontracting itself is governed by § 3.28.120, which keeps the franchisee fully responsible for providing and maintaining service and for compliance with the chapter.

Paragraph (4) covers equipment. To prevent injuries to users and collectors, stationary compacting devices for handling solid wastes shall comply with applicable federal and State safety regulations. Paragraph (7) covers contents. No person shall place hazardous waste out for collection by the franchisee, or in any container, box or vehicle owned or operated by the franchisee or by the City of Albany, without the prior permission of the franchisee's office or of the City Manager, respectively. Section 3.28.030(4) defines hazardous waste to include wastes the franchisee and the City find hazardous to service workers, to service equipment or to the public.

Two limits on this section matter. It sets no distance, setback or curb-placement standard for a dumpster or roll-off, so where a container sits on a site or in the street is not answered here. And § 3.28.020(3) bars anyone except the franchisee from providing service, which § 3.28.030(6) defines to include collection, transportation, reuse, recycling, or other resource recovery from or disposal of solid waste, subject to the exceptions in § 3.28.040(4).
