Gilroy, CA Trash & Recycling: Dumpster Rules (2026)

Gilroy City Code § 30.50.44 sets the standard conditions the planning director attaches to architectural and site approval for commercial, multifamily and other reviewed development. Subsection (b) requires that all trash enclosures consist of visually solid fences and gates six feet in height, built to the adopted City of Gilroy standard trash enclosure design plan or a similar design the planning director approves. Placement is not left to the applicant: enclosures must sit exactly where the approved site plan shows them and must also satisfy the Uniform Fire Code, so a roll-off or dumpster corral cannot be relocated to a fire lane or access aisle after approval without a new sign-off from the planning director.

The same subsection folds recycling into the enclosure requirement rather than treating it separately: recycling areas inside the trash enclosure must be adequate in capacity, number and distribution to serve the project, dimensioned to hold enough bins for the development's recycling needs, and outdoor storage generally (subsection (e)) must be screened from public view with landscaping, solid fencing, or building design. Because these are conditions of architectural and site approval under Article L, they attach at the permit stage: a developer who changes an approved enclosure's design, height or location after occupancy is out of compliance with the approval itself, not just a general nuisance rule.

Enforcement runs through Gilroy's citywide zoning enforcement provisions in Article LIII: violating any provision of Chapter 30, including an attached condition of approval, is an infraction punishable under Government Code Section 36900, with each day of a continuing violation a separate offense, and the city attorney can additionally pursue abatement of the enclosure as a public nuisance under § 30.53.30.
