City Code Sec. 25.4, the city's neighborhood preservation nuisance ordinance, makes it unlawful for a property owner to allow certain conditions to exist on their land, and subsection h. specifically targets 'storing or keeping boxes, containers or dumpsters, in excess of seventy-two (72) consecutive hours,' with two carve-outs: when otherwise permitted elsewhere in the code, or when the property has ongoing construction activity that reasonably requires a roll-off or debris box to stay longer. That 72-hour window matches the same limit the code applies to appliances, lumber, and other visible clutter left in front or side yards under subsection g., and to tents or temporary structures under subsection k., making it part of a broader neighborhood-appearance standard rather than a rule aimed only at waste haulers.

Separately, Sec. 16.9 governs the containers used for ordinary household and business garbage, requiring every occupant or owner producing garbage to keep a sufficient number of 'standard containers,' fully enclosed with close-fitting covers, capable of holding waste without spillage or escaping odors, and capping their weight at 75 pounds when full for collection, unless the disposal service operator has furnished or approved a special heavier-duty container under city regulations. That section covers the day-to-day garbage can, while Sec. 25.4(h)'s 72-hour rule covers the larger dumpster or roll-off box a contractor or business might place on a driveway or curb during a remodel or cleanout.

A violation of Sec. 25.4 is a public nuisance under Sec. 25.3, which the city can abate through the notice, hearing, and lien procedure in Sec. 25.8 through Sec. 25.9: the city can order removal, and if the owner doesn't comply, the cost of removal becomes a lien on the property collected through the tax roll. This gives code enforcement a civil abatement path in addition to, or instead of, a criminal citation.
