Gilroy, CA Trash & Recycling: Pickup Rules & Schedules (2026)

Section 12.16 of the Gilroy City Code makes two separate things unlawful. First, subsection (a) requires every owner, occupant, or person in possession, charge, or control of a place or premises in Gilroy that creates, accumulates, or produces garbage to subscribe to and use the city's own garbage collection service on the terms Chapter 12 sets out; simply declining to pay for service, or hauling your own trash instead, does not satisfy the Code. Second, subsection (b) protects the collector once service is in place: it is unlawful to hinder, threaten, impede, or obstruct any garbage collector holding a city permit under § 12.9 while that collector is performing the duties § 12.9 defines, which covers everything from blocking a route to interfering with a pickup.

A code reviser's note attached to § 12.16 explains that Ordinance No. 2023-01 repealed the intervening Ordinance No. 99-13 and restored the section to how it read before that 1999 amendment, so the current mandatory-service and anti-hindrance language is the city's earlier text under Ordinance No. 880. Chapter 12's pricing rule sits alongside the mandatory-service duty: § 12.22 makes it unlawful for any garbage collector to charge more than the maximum prices the city council fixes by resolution and keeps on file with the city clerk, so a resident who is billed above the posted rate has an independent Code violation to point to, separate from the collector's contract with the city.

Because §§ 12.16 and 12.22 both sit in Chapter 12's collection and fee divisions, they work together with the receptacle and set-out rules in §§ 12.18 and 12.19 to define the full set of pickup obligations a Gilroy household or business owes.
