New Rochelle, NY Trash & Recycling: Dumpster Rules (2026)

Section 250-4A treats dumpsters, garbage containers and storage areas as an accessory use for commercial, industrial and multifamily trash storage and requires a permit from the Bureau of Buildings before installation. The enclosure standard covers three sides with dense evergreen screening, solid fencing or solid brick walls as high as the receptacle but never lower than 48 inches, with an opaque gate on the fourth side to allow cleaning, filling and emptying. That gate must stay locked to prevent unauthorized use, the surrounding area must be kept clean at all times, no trash can be stored outside the dumpster, the dumpster must be emptied promptly when full, and every receptacle needs a cover kept fully closed.

The dumpster or storage area must sit on an impervious pad. Dumpsters placed on public property need a separate, time-limited permit from the Department of Public Works under § 250-4B, and residential-area dumpster use requires a temporary Bureau of Buildings permit good for no more than 30 days under § 250-4C. On one- and two-family properties, § 250-4D limits front-yard garbage containers and bins to evergreen or solid-fence screening no taller than four feet. Existing nonconforming dumpsters and storage areas had 12 months from the section's 1990-1991 adoption to come into compliance under § 250-4E. Section 250-4 sets no fine of its own, so enforcement runs through the Chapter 250 general penalty in § 250-7.
