" The same section requires units to avoid obstructing vehicular or pedestrian traffic, to carry workable lids, to display the owner's name, address and phone number conspicuously, to stay watertight and be kept clean, and to be promptly removed or emptied once full. Hazardous, infectious or seriously toxic waste may never go into a dumpster, compactor, shopbox or roll-off under Subsection E. Section 177-36 sets the fee: a $10 annual permit per unit, running the calendar year. Section 177-37 requires the Town-issued permit number be conspicuously displayed on the unit; failing to display it is its own separate violation.

Enforcement has real teeth for abandoned units: under § 177-35H, once a permit expires or a unit is left unmaintained it is deemed a hazard, the carter, owner and property owner get 24 hours' notice to remove it, and if it is still there after 24 hours the Town treats it as abandoned, removes it at the responsible party's expense, and adds a $250 impound fee plus $50 per day or part of a day the unit sits in Town custody. If the unit remains impounded more than 10 days, the Town sends certified notice that title will vest in the Town of Smithtown unless removed and all costs paid within 48 hours.
