Chapter 9, Article 2 (Litter), adopted by the Representative Town Meeting on September 20, 2010, defines litter in § 9-12 to include garbage, landscape debris and rubbish, and a public place to mean any street, sidewalk, alley, park or other public way or ground. Section 9-13 makes it unlawful to throw or deposit litter in or upon any street, sidewalk or other public place except in public receptacles, authorized private receptacles, or official Town disposal areas. Section 9-19 goes further and bars dumping litter on any occupied, open or vacant private property in Town, whether the dumper owns it or not, though an owner may still keep an authorized private receptacle or a yard-waste recycling area if it is managed so nothing blows or spills onto a street, sidewalk or neighboring property.

Related sections reinforce the ban: § 9-15 prohibits sweeping litter into a gutter and requires property owners to keep the sidewalk in front of their premises free of litter, § 9-16 bars throwing litter from a moving vehicle, § 9-17 requires loads to be covered so nothing blows off, and § 9-18 bars depositing litter into any fountain, pond, lake, stream or bay in Town. Section 9-20 separately obligates every owner or person in control of property to keep the premises free of litter at all times.
