Idaho Falls prohibits depositing or burying refuse on public property or another's premises (City Code 8-6-6) and unauthorized use of others' containers (8-6-7). Statewide, Idaho Code 18-7031 makes placing debris on public or private property an infraction starting at a $150 fine, escalating to a misdemeanor for repeat offenders.
Illegal dumping in Idaho Falls is addressed by both City Code and Idaho state law. Under City Code Section 8-6-6, it is unlawful to deposit or bury refuse in or upon any public alley, street, park, or other public property, or upon the premises of another without the consent of that property's occupant. Section 8-6-7 makes it unlawful to deposit refuse into a waste container owned or leased by another without permission, and Section 8-6-16 prohibits scattering the contents of any waste container upon a street, alley, right-of-way, or public park. The Litter chapter likewise bars improper hauling that causes litter to be deposited or blown onto streets, sidewalks, or private property (5-8-7). Statewide, Idaho Code Section 18-7031 ("Placing Debris on Public or Private Property") makes it unlawful to deposit debris, paper, litter, glass bottles, glass, nails, cans, boards, trash, garbage, lighted material, or other waste substances on public or private property not authorized by the owner or a government entity. A first offense is an infraction punishable by a fine of one hundred fifty dollars ($150); a second conviction within two years is an infraction with a fine not exceeding three hundred dollars ($300); and a third conviction within three years is a misdemeanor punishable by a fine not exceeding one thousand dollars ($1,000) and up to thirty (30) days in the county jail. Courts may also order 8 to 40 hours of supervised cleanup service. Suspected dumping can be reported to Idaho Falls Code Enforcement.
City Code 8-6-6, 8-6-7, and 8-6-16 violations are unlawful. Under Idaho Code 18-7031: first offense $150 fine; second conviction (within 2 years) up to $300; third conviction (within 3 years) a misdemeanor up to $1,000 and up to 30 days jail, plus possible 8-40 hours cleanup service.
