Irvington, NJ Trash & Recycling: Illegal Dumping (2026)

Adopted in 2016 by Ord. No. gallons of liquids at a site that has not received authorization from the New Jersey Department of Environmental Protection or the Board of Public Utilities to accept such materials. Dumping below that threshold instead falls to the article's other, lower-penalty sections. Because the standard applies 'regardless of intent,' the Township does not have to prove the dumper meant to break the law, only that the volume and lack of authorization are established. A conviction is a disorderly persons offense, and the fine schedule escalates by offense: a minimum of $2,500 per day for a first offense, up to $5,000 per day for a second, and up to $10,000 per day for a third and beyond, with imprisonment in the county jail for up to six months available in addition to or instead of the fine.

Every day the dumped material remains is treated as a separate violation, so an uncleared pile can generate a new charge daily. The section also authorizes immediate confiscation and forfeiture of any vehicle or other instrument used to commit the violation, giving the Township's Public Safety Department a direct tool against dumpers who use a truck or trailer to haul waste onto a lot.
