Maricopa's code directly targets illegal dumping. MCC 8.05.020(C) states 'it is unlawful for any person to place or cause to be placed any refuse upon any public or private property within the city, except as specifically permitted' in the solid waste chapters. MCC 8.10.030 makes it unlawful to 'place any rubbish, trash, filth or debris upon any private or public property not owned or under the control of said person,' and makes the offender liable for removal costs. The nuisance chapter (MCC 8.20.040) prohibits throwing anything injurious into ditches, dumping animal manure on ditches, streets, alleys, sidewalks, vacant lots, or public property, and leaving abandoned materials or construction debris on the right-of-way. If the party does not abate after citation (a maximum 14-day cure period), the city may remove the material at the violator's expense, and the cost becomes a recorded lien (MCC 8.20.040(C)-(D)). Illegal dumping is also a state crime under A.R.S. 13-1603 (Criminal littering or polluting): a person commits it by, without lawful authority, throwing, placing, or dropping litter on public property or another's property that is not a lawful dump and not immediately removing it. Penalties scale with quantity and intent — a Class 6 felony for a knowing violation exceeding 300 pounds or 100 cubic feet, or done for commercial purpose; a Class 1 misdemeanor for knowing violations over 100 but under 300 pounds (or over 35 but under 100 cubic feet) not for commercial purpose; and a Class 2 misdemeanor otherwise. Maricopa directs residents to use contracted collection, self-haul, or approved facilities rather than dumping.
Dumping refuse, debris, manure, or construction material on streets, alleys, ditches, vacant lots, or the right-of-way violates MCC 8.05.020(C), 8.10.030, and 8.20.040, triggering abatement and cost recovery (recordable as a lien).
