04. 050 bars anyone who possesses or controls solid waste or divertible material from throwing, depositing, or leaving it in any street, public beach, or other public place, on the shore, or in the waters of Newport Bay. 200 extends the ban to private land: subsection (A) prohibits dumping on the property of another without the owner's knowledge and prior permission, and subsection (B) prohibits an owner from dumping, or knowingly letting anyone else dump, on the owner's own real property. If waste turns up on a property, the owner must wholly remove it within three days after receiving written notice from the Code Enforcement Supervisor or the Municipal Operations Director, or the owner is in violation regardless of who actually dumped it.

Subsection (C) adds that an owner may not knowingly let tenants dump on someone else's property while occupying the premises. 030 separately declares any accumulation of solid waste on private or public property a public nuisance. 010(A), punishable by a fine not exceeding $100 for a first offense, $200 for a second offense of the same ordinance within a year, and $500 for each additional offense within that year. 010(D) seeking penalties up to $1,000 per day the violation continues. The Municipal Operations Director and Code Enforcement Supervisor are the officials named with authority to issue the three-day removal notice.
