Summary

Every occupied property in Antioch must subscribe to the city's three-container collection service, separating trash, recyclables, and food-scrap organics into the correct cart. Antioch Municipal Code Sec. 6-3.02 makes noncompliance unlawful and lets the city adjust service levels or bring abatement action against a holdout owner.

(A) Single-family organic waste generators shall comply with the following requirements.

(1) Shall subscribe to the city's three-container collection services for trash, recyclable materials, and organics. The city shall have the right to review the number and size of a generator's containers to evaluate adequacy of capacity provided for each type of collection service for proper separation and containment of materials; and, single-family generators shall adjust their service level for collection services as requested by the city.

(2) Shall participate in the city's three-container collection service(s) by placing designated materials in designated containers described below and shall not place prohibited container contaminants in collection containers. The generator shall place source separated organic waste, including food waste, in the organics container; source separated recyclable materials in the recycling container; and trash in the trash container. Generators shall not place materials designated for the trash container into the organics or recycling container.

Full Breakdown

Antioch Municipal Code Sec. 02 requires every owner, manager, or person in control of an occupied property to subscribe to the city's franchised three-container collection service for trash, recyclable materials, and organics, and to keep that service adequate for the property. Single-family generators must place source-separated organic waste, including food waste, in the organics cart, source-separated recyclables in the recycling cart, and everything else in the trash cart; the section expressly bars dumping trash-bound material into the organics or recycling container. Commercial businesses and multi-family dwellings of five units or more face a longer list of duties: they must supply enough labeled or color-coded containers for employees, tenants and customers, train staff annually on sorting, give new tenants sorting information within 14 days of move-in, and let the city inspect for contamination.

Landlords of leased single-family homes, apartments, flats, duplexes, or multi-family buildings must arrange and pay for adequate service for every occupant even if the tenant is billed. A property owner may ask the City Manager for an exemption only by showing the premises are unoccupied, and an owner with an active irrigation-only water account may separately apply to drop solid waste service. Nothing in the section stops a resident from managing organic waste on-site or using a community composting site instead of the cart under 14 CCR Sec. 9(c). The ordinance implements the state's SB 1383 short-lived-pollutant mandate and was last amended by Ordinance 2200-C-S on January 11, 2022.

Violations & Fines

Failing to subscribe for or correctly sort trash, organics, and recyclables is unlawful under Sec. 6-3.02(E) and is punishable under Antioch Municipal Code Secs. 1-2.01 et seq. Beyond a citation, the city can order the franchised contractor to adjust an account's service level in six-month increments or pursue abatement. If the City Manager's designee finds a property out of compliance, written notice gives the owner ten days to subscribe before penalties continue.

Frequently Asked Questions

Can I compost at home instead of using the organics cart in Antioch?
Yes. Antioch Municipal Code Sec. 6-3.02 says nothing in the section stops a generator from preventing or reducing waste, managing organic waste on-site, or using a community composting site under 14 CCR Sec. 18984.9(c), so backyard composting is allowed as an alternative to the organics container.
Do landlords or tenants pay for Antioch's trash service?
The owner is responsible. Section 6-3.02(C) makes the owner of any leased single-family home, apartment, flat, duplex, or multi-family building ensure adequate collection and disposal service for every occupant and pay the charges, even though Sec. 6-3.02(H) lets the owner require the tenant to actually subscribe.
What happens if I never sign up for trash service in Antioch?
The city can send written notice under Sec. 6-3.02(F) giving you ten days to subscribe, and failure to comply is unlawful under Secs. 1-2.01 et seq. The city may also direct the contractor to adjust your service level or begin abatement action against the property.
