2(b) sets a two-stage mandate. Starting June 1, 2023, any commercial establishment generating at least one cubic yard of food waste a week had to separate that food waste from the general waste stream and collect it in containers kept apart from garbage and recovered materials. By June 1, 2026, the requirement extends to essentially every commercial establishment, with an exception only for businesses whose food waste generation is both de minimis and under one cubic yard a week. On request, the city manager or designee can require a business to produce receipts showing delivery of its food waste to a state-permitted processing facility, or proof of a current contract with a registered food waste collector.

The rule also reaches multifamily rental communities: commercially-collected residential properties, including those run by landlords, management companies, condo associations, and HOAs, had to establish a full food waste collection program by June 1, 2024, complete with an accessible common-area container, posted signage listing accepted materials, tenant notices at lease signing and annually, and, since October 1, 2023, an indoor food waste container supplied for each unit. Businesses and residential properties that can show a lack of available service providers, or that lack space for another container, can apply for an exemption on city forms, renewed at least every six months, with a written decision due within 60 days.
