Section 27-85 makes recycling separation mandatory for commercial generators. A business has to keep designated recyclable materials out of solid waste loads delivered to a city facility, a city-contracted facility, or its own dumpster at the point of generation, aside from de minimis amounts the city manager or designee allows. Before the city issues a civil citation under sections 2-336 through 2-339, it first has to send the generator a notice of noncompliant status with a compliance date; only a follow-up inspection that still finds the business out of compliance triggers the citation, and the city can also perform the separation or a special pickup itself and add the cost as a surcharge to the generator's utility bill.

A business can appeal a surcharge to the city manager or designee within 15 calendar days, and the city manager or designee has 15 calendar days to affirm or abate it, with that decision being final. Any commercial establishment that puts out public garbage receptacles must place an equal number of recycling receptacles next to them, or work with the city on an alternative placement plan if space doesn't allow it. Property owners serving commercial tenants must provide space for shared recycling containers in a convenient, safely accessible location.

Commercial generators can also request an exemption from the paired-receptacle requirement if their recycling volume is de minimis or no space exists for another container, using standardized city forms, with a decision due within 60 days.
