Section 94-11, 'Hours of prohibited removal,' was added to Chapter 94 on October 27, 1987, and states a single flat rule: no refuse shall be collected from any premises in the Town of West Hartford from 9:00 p.m. to 6:00 a.m. It applies chapter-wide, covering both the Town's own contracted residential collection under § 94-5 and licensed private haulers operating under § 94-2, and it draws no distinction between residential, commercial or industrial premises. Read together with § 94-1's definition of 'collector,' anyone who holds himself or herself out for hire to collect solid waste from residential, business, commercial or other establishments, the hours restriction reaches any hauler working in Town, not just a municipal contractor.

Enforcement of the hours rule sits with the Director of Public Works or a designee under § 94-9, the same office that enforces the rest of Chapter 94, including the hauler licensing requirement of § 94-2 and the salvage restriction of § 94-8 that bars private operators from picking through curbside refuse. Because the restriction is keyed to the premises being served rather than the truck's route, a hauler cannot use an early-morning or late-evening run through West Hartford to catch a stop it missed during the permitted window; that stop has to wait until 6:00 a.m.

The rule sits alongside the Town's separate noise regulations in Chapter 123, giving residents two distinct hooks, this section and the Noise chapter, to raise an out-of-hours collection with the Town.
