Full Breakdown

Any multi-family complex with five or more dwelling units must comply with Public Resources Code § 40004 (Mandatory Commercial Recycling/Diversion) by either source-separating recyclables and subscribing to the city's exclusive franchisee for separate pickup, or subscribing to a mixed-waste processing service that yields comparable diversion. Container location is agreed between site management and the franchisee, but containers can't sit in public streets or right-of-way. Non-residential generators of four or more cubic yards of solid waste weekly face the same diversion duty under the neighboring § 8.04.400(C). Only one citywide franchisee may provide the service.

Violations & Fines

Non-compliance is enforced under HMC § 8.04.495: the city can issue a written notice of violation and, after notice and a right to appeal, revoke permits; general code violations carry up to a $1,000 fine and/or six months in jail as a misdemeanor, or a reduced infraction fine, under HMC § 1.12.030.
