It applies to the owner or operator of a business that contracts for solid waste service and generates more than four cubic yards of total solid waste per week, and separately to any multifamily residential dwelling of five or more units. Covered generators must arrange for recycling services consistent with state or local requirements, including any local ordinance or agreement governing collection, handling, or recycling of solid waste, to the extent those services are reasonably available from a local provider. Subsection (b) gives the generator two compliance paths: separate specified recyclable materials from solid waste and subscribe to a basic recycling service that collects those materials (or use an authorized self-haul arrangement), or subscribe to an alternative recycling service, such as mixed waste processing, that achieves diversion results comparable to source separation.
