Summary

El Monte makes it unlawful for anyone but the container's owner, the property owner, or the franchised hauler to remove, rummage through, or scavenge recyclable materials once they're set out for collection. Municipal Code Section 8.20.030 protects the city's blue-cart recycling stream from can-and-bottle pickers, and Section 8.20.080 separately bars contaminating recyclables with hazardous or medical waste.

A. General Prohibition. No person shall remove, rummage through or scavenge the contents of any container used to gather, contain and/or store solid waste and/or recyclable materials pending routine collection by a franchisee. B. Limited Exceptions to General Prohibition. The prohibition set forth under subsection A of this section shall not apply to: 1. The owner of the container; 2. The owner (including the agents and employees of the owner) of any premises, or real property parcel to which the container has been provided pursuant to a contractual arrangement authorized under this chapter between the owner and a franchisee; 3. The tenant (including the agents and employees of the tenant) of any premises or other real property parcel to which the container has been provided pursuant to a contractual arrangement authorized under this chapter between the tenant and the franchisee who has provided the container; 5. The agents or employees of any franchisee.

Full Breakdown

030 bars any person from removing, rummaging through, or scavenging the contents of a container holding solid waste or recyclable materials while it awaits routine collection by the city's franchisee. The prohibition exempts only the container's owner, the owner of the premises the container serves (and that owner's agents and employees), a tenant who received the container under a franchise arrangement, and the franchisee's own agents and employees acting within the scope of their job. Anyone else pulling cans, bottles, or cardboard from a curbside blue cart, whether for resale or any other purpose, is violating the section.

080 prohibits knowingly contaminating recyclable materials, green waste, or solid waste already placed in a container with any substance that would make the load unacceptable for recycling, reuse, or remanufacture, listing hazardous substances, hazardous waste, hazardous contaminants, radioactive waste, and medical waste as examples of banned contaminants. 170(B), separate from solid waste service, unless a written lease authorizes the tenant to contract directly with the franchisee. 150 preserves the separate right of any person to donate or sell recyclable materials they own instead of placing them in a collection container, as long as the disposal still follows the chapter.

Violations & Fines

Scavenging or contaminating a recycling container, or failing to retain franchised recycling service, is enforced under Chapter 8.20's general penalty at Section 8.20.200: a misdemeanor punishable by up to six months in county or city jail, a fine of up to $1,000, or both. Each day a violation continues counts as a separate offense.

Frequently Asked Questions

Is it illegal to take cans and bottles out of someone else's recycling bin in El Monte?
Yes. Municipal Code Section 8.20.030 makes it unlawful for anyone besides the container's owner, the served property's owner or tenant, or the city's franchised hauler to remove, rummage through, or scavenge a container holding recyclable materials once it's set out for collection. Violators can be cited under the chapter's general penalty section, which allows up to a $1,000 fine and six months in jail.
Can I put paint cans or motor oil in my El Monte recycling bin?
No. Section 8.20.080 prohibits knowingly contaminating recyclable materials placed in a container with hazardous substances, hazardous waste, hazardous contaminants, radioactive waste, or medical waste, even if the material could theoretically be cleaned out of the load. Doing so is a chapter violation subject to the same misdemeanor penalty as other solid-waste offenses.
Do I have to use the city's recycling hauler, or can I keep my own bottles and cans?
You can keep and sell what you own. Section 8.20.150 protects the right to donate or sell recyclable materials that belong to you, but Sections 8.20.160 and 8.20.170 still require every nonvacant residential, commercial, or multifamily property to retain El Monte's franchised hauler for recyclable-materials collection service unless a written lease lets a tenant contract directly.
