Weston, FL Water Use Rules: Recycled Water Rules (2026)

Section 123.21 of the Weston Code sets mandatory year-round landscape irrigation conservation measures implementing the South Florida Water Management District's Chapter 40E-24, F.A.C. schedule. Under 123.21(C)(1), landscape irrigation is banned daily between 10:00 a.m. and 4:00 p.m., and existing landscaping may only be watered on assigned days tied to street address: even addresses may water Thursdays and/or Sundays, odd addresses Wednesdays and/or Saturdays. Section 123.21(B)(1), however, expressly removes irrigation 'accomplished using Reclaimed Water or saltwater' from the entire section, alongside athletic play areas and agricultural operations including nurseries.

Reclaimed water is defined in the Code's citywide definitions as wastewater that has received at least secondary treatment and basic disinfection and is reused after leaving a wastewater treatment facility, tracking Florida Administrative Code Rule 62-40.210. Even a declared SFWMD Water Shortage or Water Shortage Emergency, which under 123.21(B)(2) otherwise supersedes the City's own schedule for other users, does not reach reclaimed-water or saltwater irrigators; that subsection separately states the shortage declaration 'shall not apply to Users using Reclaimed water or saltwater.' Users on other water sources who need relief from the assigned watering days must instead petition the City Manager for a variance under 123.21(E) and show hardship; reclaimed-water users need no such variance because the restriction never reaches them. The City Manager's office enforces the section, and violations of the schedule are punished under the Code's general penalty, § 2.99.
