Sec. 5 acres. Subsection (e), added by Ordinance No. 5660 on October 11, 2023, layers a density and height bonus on top of that baseline for qualifying office projects. To qualify, the new office building or office expansion must be approved under a site plan or site plan amendment dated after October 11, 2023; the new or expanded office square footage must exceed 50,000 square feet; that office space must make up more than half of the total building square footage under the same site plan; and the plot must carry the Planned Mobility (PM) future land use designation.

In exchange, Sec. 28-980(e)(3) requires the applicant to submit a transportation demand management program that includes participation in the city's transit programs and payment of an annual fee set as a condition of site plan approval, to provide or widen sidewalks along all street frontages to at least 8 feet, and to plant canopy street trees at intervals of no more than 35 feet on center in a planting zone at least 4 feet wide.
Violations & Fines
A project that claims the higher 100-foot height, 0.85 FAR or reduced parking without meeting all four eligibility criteria in Sec. 28-980(e)(1), or without completing the required TDM program, sidewalk widening and street tree planting under Sec. 28-980(e)(3), is out of compliance with its site plan and subject to development services department review, permit denial, or a stop-work order until the LIRP standard 85-foot height and 40 percent coverage limits are met instead.
