Lake Elsinore allows garages to be converted to accessory dwelling units under LEMC 17.415.110, which implements California Government Code 65852.2. No setback is required for an existing, legally permitted garage converted to an ADU, but the conversion cannot add any new encroachment into the setback.
Under LEMC 17.415.110, converting an existing, legally permitted garage to an accessory dwelling unit is approved ministerially and requires no setback, so a converted garage may remain in its existing footprint. However, no addition may be built onto it that increases the encroachment into a required setback. A garage-conversion ADU must provide an independent exterior entrance, may include no more than two bedrooms, and is subject to the recorded deed restriction barring separate sale and rentals under 31 days. Where the conversion is wholly within the existing structure, no additional parking is required even if covered parking is lost. A building permit through Building and Safety is required to confirm egress, electrical, and structural compliance.
Converting a garage to living space without permits, or adding to a converted garage so it increases setback encroachment, is a code violation. Lake Elsinore Code Enforcement may issue citations and require correction or removal under LEMC Chapter 1.16.
